1. Services Provided

HeadFirst offers a range of creative services, including:

• Social media content creation (photos, videos, and copywriting)

• Social media posting and scheduling services

• Social media branding (profile pic, cover photo)

• Analytics tracking and performance reporting

• Optional graphic design services

Details of each service will be outlined in individual agreements or proposals.

2. Client Responsibilities

To ensure smooth collaboration, clients agree to:

• Provide necessary access to social media platforms (e.g., login credentials, admin permissions).

• Supply any requested content, brand guidelines, or posting schedules on time.

• Respond promptly to communications to avoid delays in delivery.

Failure to provide access or respond promptly may delay project timelines.

3. Fees and Payment

• Payment Terms: All services are billed at the rates outlined in your service agreement. Payment is due within 15 days of invoice.

• Hourly Rate: Social media posting services are charged at $100/hour

• Late Fees: Payments not received within the agreed timeframe may incur a 15% late fee.

• Refunds: Due to the nature of creative services, all payments are non-refundable once work has begun.

4. Marketing Communications and Consent

By engaging with our services, you agree to receive marketing emails and promotional updates from HeadFirst. You can opt out at any time by clicking the unsubscribe link in our emails or contacting us at [email protected].

5. Revisions and Feedback Policy

• Included Revisions: We allow unlimited revisions as part of each project.

• Approval Delays: If feedback is not provided within 15 days of content submission, the project will be considered approved.

6. Platform Policies and Limitations

HeadFirst will comply with the terms and conditions of third-party platforms (e.g., Facebook, Instagram). However, we are not responsible for changes in these platforms that affect your content's performance or visibility.

7. Intellectual Property and Usage Rights

• Ownership: Content created for your business is exclusively yours upon full payment.

• Portfolio Use: We reserve the right to showcase completed projects as part of our portfolio or marketing efforts, unless otherwise agreed in writing.

8. Termination of Services

Either party may terminate the agreement with 30 days written notice. Any services rendered up to the termination date will be invoiced and must be paid in full.

9. Confidentiality

We respect your confidentiality and will not disclose any proprietary information shared during our collaboration.

10. Limitation of Liability

We are not responsible for:

• Loss of revenue, data, or platform access due to external factors.

• Content removed or blocked by third-party platforms.

• Unforeseen delays caused by external circumstances (e.g., platform outages).

Our liability is limited to the amount paid for services rendered.

11. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, such as natural disasters, internet outages, or platform disruptions.

12. Governing Law

These Terms will be governed by and interpreted under the laws of Michigan, United States, without regard to its conflict of laws principles.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on our website with the new effective date. Continued use of our services constitutes acceptance of any updated Terms.
